In the Matter of Awarding Letters of Administration upon the goods, chattels and credits of Lucy REIGLE, late of the Town of Romulus, said County. Deceased.

To the Surrogate's Court of the said County of Seneca and State of new York:-

The petition of John H. REIGLE, residing in the Town of Romulus, in the County of Seneca and State of New York, respectfully shows:-

Your petitioner alleges and states that Lucy REIGLE, late of the Town of Romulus, in said County of Seneca and State of New York, died on or about the 9th day of January, 1908, and the said decedent was at the time of her death a resident of said County and State.

Your petitioner further shows that he has made diligent search and inquiry for a last will and testament of the said decedent and has not found any or obtained any information that said decedent left any, and that to the best of your petitioner's knowledge, information and belief, the said decedent died without leaving a will.

Your petitioner further alleges that the following named persons, as far as they are known to or can be ascertained by your petitioner with due diligence, are the only heirs and next of kin of said decedent, her surviving, and their relationship, ages and places of residence, are as follows:-

That said decedent died an unnatural and instantaneous death on the said 9th day of January, 1908, near Kendaia in the Town of Romulus, Seneca County, New York, by reason of being struck by a locomotive passing along the tracks of Lehigh Valley Railroad Company, where they intersect the highway at grade, as the said Lucy REIGLE was lawfully passing over said tracks in the public highway, through no carelessness or negligence on the part of said decedent, but was killed by reason of the negligence of said Lehigh Valley Railroad Company, its officers, agents, servants or employees; that by reason of said death, the administrator of the estate of said deceased has a cause of action against the said Lehigh Valley Railroad Company for damages in the sum of Fifteen Thousand Dollars ($15,000.00).

That the value of all the personal property, whereever situated, of which the said decedent died possessed, does not exceed about Two Hundred and Fifty Dollars ($250.00) in value.

That said decedent died seized and possessed of an interest in real estate with others; that no petition of the granting of letters of administration upon the said estate has been filed in any Surrogate's Court of the State of New York, as your petitioner is informed and believes.

That your petitioner is of full age and is the surviving husband of said decedent and is the first entitled to letters of administration upon her estate, and that your petitioner is informed and believes that the Surrogate of said County has the sole and exclusive power to grant letters of administration of the goods, chattels and credits of said intestate.

Your petitioner, therefore, prays, that such letters of said decedent may be granted to him and that such persons, having a right to such letters prior or equal to that of your petitioner, as this Court may direct, be cited to show cause why such a decree should not be made and that all such process and proceeding may be had and taken in this proceeding to the end that letters of administration be granted upon the estate of said decedent as the law may require.

At a Surrogate's Court held in and for the county of Onondaga, at the Surrogate's office in the City of Syracuse, on the 12th day of August in the year of our Lord one thousand eight hundred and fifty two.

Present, L. Morris HISCOCK, Surrogate.

In the matter of proving the Last Will and Testament of Jacob RIEGEL deceased.

Onondaga County, ss. BE it REMEMBERED, That heretofore upon the petition of Elizabeth RIEGEL Executrix named in the last Will and Testament of Jacob RIEGEL late of the City of Syracuse in said county deceased, for that purpose to the Surrogate of said county: a citation was duly issued in this matter, which citation with the proofs of service thereof were thereafter duly returned to said Surrogate and which said petition and citation, with the proofs of service thereof are now on file in the office of said Surrogate

And thereupon the last Will and Testament of the said deceased and the proofs thereof were produced and are as follows, viz.

The Last Will and Testament of Jacob RIEGEL of the City of Syracuse, Onondaga County New York

I, Jacob RIEGEL, of the second Ward of said City, considering the uncertainty of this mortal life and the certainty of death, and being yet of sound mind and memory, blessed be God for it, and for the purpose of making a final disposition of all my real and personal Estate do make and publish this my last will and testament.

First, I will and devise to my affectionate wife Elizabeth RIEGEL one third of all my real and personal estate expressly in lieu and instead of the right of dower she would otherwise have in my real estate and also expressly instead of the one third of my personal property and estate to which she would have been entitled had I died intestate.

Second, I will and devise the remaining two thirds of my real & personal property to and to be divided in four equal proportions among my dearly beloved children, Eliza Mary, Albert Jacob, Ellen Amelia & Emma Lovina, to be held owned and enjoyed by them as their individual portions of my estate.

Third I hereby constitute, nominate and appoint Israel SPENCER of Syracuse & John RIEGEL my brother, the executors and my wife Elizabeth RIEGEL the Executrix of this my last will & testament and authorize & empower them & any two of them to sell and convey or mortgage or lease with such coo__inants as they shall think best - any real estate or any property I may own at the time of my death, and to settle adjust and compound any claim or demand in favor of or against my estate. And I authorize them to pay & defray the expenses of my funeral & burial and erect such a monument at my grave as they shall think best and to pay for the same and said expenses out of my estate

In conclusion I want to say to my dear children, remember to be always kind and affectionate to your dear Mother and be industrious and live according to the principles of the religion of Christ.

Onondaga County, SS. Peter MILLER of the City of Syracuse in the county of Onondaga being duly sworn and examined, doth depose and say that he this deponent was well acquainted with Jacob RIEGEL late of the City of Syracuse in the county of Onondaga, deceased.

That this deponent was present as a witness and did see the said Jacob RIEGEL subscribe at the end thereof the instrument now produced and shown to this deponent, purporting to be the last will and testament of the said deseased, bearing date the sixteenth day of June in the year of our Lord one thousand eight hundred and fifty two. That the said testator at the same time declared the instrument so subscribed by him to be his last will and testament. That thereupon this deponent and Herman ACKERMAN of said City of Syracuse, subscribed their names at the end thereof as witnesses thereto at the request of the testator and in his presence, and that the said testator at the time or executing and publishing the said last will and testament was of full age and of sound mind and memory not under restraint, and was in all respects competent to make a last will and testament.

In the matter of proving the Last Will and Testament of Jacob RIEGEL, deceased}

Onondaga County, ss. Herman ACKERMAN of the City of Syracuse in the county of Onondaga, being duly sworn and examined, doth depose and say that he, this deponent, was well acquainted with Jacob RIEGEL late of the City of Syracuse in the county of Onondaga, deceased. That this deponent was present as a witness and did see the said Jacob RIEGEL subscribe at the end thereof the instrument now produced and shown to this deponent, purporting to be the last will and testament of the said deceased, bearing date the sixteenth day of June, in the year of our Lord one thousand eight hundred and fifty two. That the said testator at the same time declared the instrument so subscribed by him to be his last will and testament. That thereupon this deponent and Peter Miller of said City of Syracuse subscribed their names at the end thereof as witness thereto at the request of the testator and in his presence, and that the said testator at the time of executing and publishing the said last will and testament was of full age and of sound mind competent to make a last will and testament.

The last will and testament of Elizabeth RIEGEL, of the Town of Seneca Falls, County of Seneca and State of New York: I, Elizabeth RIEGEL, do make, ordain, publish and declare this my last Will and Testament, in the manner and form following, that is to say;

After the payment of my funeral charges, the expenses of administering my estate, and my lawful debts, I give, devise and bequeath my property as follows:

I give, devise and bequeath to my son, William W. RIEGEL of the Town of Seneca Falls, aforesaid, all of my property, real and personal of which I may die seized, wherever the same is situate, to have and to hold to himself and his heirs forever.

Likewise I make, constitute and appoint my said son William W. RIEGEL, to be the sole Executor of this my last Will and Testament, hereby revoking all former Wills by me made.

In Witness Whereof I have hereunto subscribed my name and affixed my seal the 17th day of March, 1893.

The Petition of William W. RIEGEL of the town of Fayette, Seneca County respectfully shows:

That your petitioner is nominated as sole Executor of the last will of Elizabeth RIEGEL deceased.

That the said Elizabeth RIEGEL, being then a resident of the town of Fayette, in the county of Seneca and State of New York, died therein on or about the 7th day of February 1901, leaving personal property within this County and leaving a last Will and Testament, bearing date the 17th day of March 1893, executed as prescribed by the laws of the State of New York, relating or purporting to relate to real and personal property in and by which Will your petitioner, William W. RIEGEL is designated as sole executor thereof.

That said decedent left her surviving no husband; and that the names, places of residence and degree of relationship of all the heirs at law and next to kin of the said decedent, with their respective ages and places of residence, are as follows, to wit:

Henry J. RIEGEL, Fayette, Seneca Co. N.Y. a son of said decedent.
Susan M. REED, Fayette, Seneca Co. N.Y. a daughter of said decedent.
William W. RIEGEL, Fayette, Seneca Co. N.Y. a son of said decedent, and the petitioner herein - all are of full age

That, as your petitioner is informed and believes, no petition for the probate of the said Will has been filed in any Surrogate's Court of this State. That as your petitioner is informed and believes, that the real estate of said Testator does not exceed in value the sum of $1000.00.

Wherefore your petitioner prays that the said Will may be proved, and that the said heirs at law and next to kin of the said decedent, may be cited to attend the probate thereof, and for all such other or further relief in the premises as may be just and proper and the nature of the case may demand.

Last Will and Testament.
I, Jacob F. REIGLE of the Town of Varick in the county of Seneca and State of New York, being of sound mind and memory, do make, publish and declare this my last Will and Testament, in manner following, that is to say:

First --I direct that all my just debts and funeral expenses be paid.

Second--I give and Bequeath to the Oak Hill Cemetery Association situate in the Town of Varick Seneca County New York Seventy-five Dollars to be invested in some good reliable financial Security Company to remain in Tact forever the Interest of the Said Seventy five Dollars only to be used for the care and maintance of the Burial Lot upon which my wife is buried in Said Oak Hill Cemetery.

Third--I give Bequeath and Devise the rest residue and remainder of my Property both Real and Personal of whatever name or nature and wherever found to Harvey E. RITTER my nephews, Foster E. RITTER my nephew, my nieces Blanch E. RITTER, Bertha E. UPDIKE, Florence E. LEWIS, Eva RODGERS and Benjamin RODGERS, Children of my Deceased sister Rosana REIGLE, Edna R. NOYS share and share alike. I direct my Executor herein after named to sell my Real Estate of which I may die seized or possessed and convert the same into money for the purposes set forth herein.

Lastly, I hereby appoint Henry M. BURTON executor of this, my last Will and Testament: hereby revoking all former wills by me made.

RIEGEL late of the Town of Varick in the County of Seneca aforesaid, departed this life on or about the 12th day of September in the year of our Lord one thousand nine hundred and twelve

The said deceased was at the time of his death, a resident of the Town of Varick in the County of Seneca

Said deceased left a Last will and Testament, which is dated the Fourth day of April in the year of our Lord one thousand nine hundred and twelve. Your petitioner is the sole executor named in said Will. The said deceased left no widow him surviving. The following named persons are the only heirs-at-law and next-of-kin of said deceased, and their degree of relationship to the said deceased, their places of residence and postoffice addresses are respectively as follow, viz:

I George REIGEL of the village of Seneca Falls, Seneca Co., New York of the age of seventy two being of sound mind and memory and being fully convinced of the uncertainty of life and the certainty of Death, do make publicly and declare this my last will and testament in manner following - that is to say

First:
I give and bequeath to my true and well beloved wife Mary REIGEL all my household furniture, all my beds and bedding, all my dishes and silver ware, all book and family pictures, all stores, and all my household good of every name and kind whatsoever the same may wish of at my decease to my said wife for her to have and hold the same forever.

Second:
After the payment of all my just Debts I give and devise to my said wife Mary REIGEL the use of all the rest, residue and remainder of my property both real and personal, whatsoever the same may consist of to have and hold the use of the same, during her natural life, and at her decease the said property both real and personal is to be equally divided among my children, share and share alike and in case any of my children should die leaving children, the share such child would receive if living shall be equally divided among such childrens' heirs, and the above said bequeaths my said wife is to have and accept in lieu of dower.

Lastly:
I do hereby constitute and appoint my said wife Mary REIGEL and my son Charles W. REIGEL the executors of this my last will and testament, giving and granting to my said executors full power and authority to sell and give Deed for any and all my real estate, and count the same into money for and towards the performance of said testament - hereby revoking all former wills by me made.

That George RIEGEL late of the town of Seneca Falls in the said County of Seneca deceased, died in the said town of Seneca Falls on or about the 13th day of October in the year of our Lord one thousand eight hundred and seventy nine being at that time an inhabitant of the County of Seneca. that he died, leaving a last Will and Testament which is now produced in the Surrogate's Court of the said County of Seneca before the said Surrogate, which bears date the 12th day of March in the year of our Lord one thousand eight hundred and seventy-nine and by which said last Will and testament the said deceased nominated and appointed Mary Reigel and Charles W.
